Tomasz Pacholec
PRIOR EXPERIENCE

Before joining Calcagni & Kanefsky, Tom served as an associate attorney at an international labor and employment litigation firm, providing advice and counsel to clients regarding various employment-related issues. Tom defended employers in New York and New Jersey state and federal courts in the areas of discrimination, harassment, retaliation, reasonable accommodation, wage and hour actions, and Department of Labor audits.

Tom previously served as Assistant Corporation Counsel in the Labor & Employment Law Division of the New York City Law Department, defending the City of New York, its agencies, and high-ranking employees in federal and state court actions and special proceedings concerning federal, state, and city discrimination, retaliation, and wage and hour claims.

Tom began his legal career as a judicial clerk for Judge Lisa A. Firko of the Superior Court of New Jersey, Family Division, Bergen County.

REPRESENTATIVE MATTERS
  • Serves on CK team investigating employment complaints in the Executive Chamber of the Governor of the State of New York.
  • Successfully defended businesses in federal and state court litigation involving discrimination and retaliation claims under Title VII of the Civil Rights Act, the Age Discrimination in Employment Act, the Americans with Disabilities Act, the Family Medical Leave Act and their New York and New Jersey state counterparts.
  • Represents businesses in Department of Labor audits concerning prevailing wage issues and misclassification of employees.
  • Provides counseling on personnel decisions, performance management, accommodation requests and leaves of absence, workplace investigations, and legal compliance issues.
  • Develops, drafts, and revises internal corporate policies, procedures, and handbooks to assist businesses with various risk prevention strategies.
LEADERSHIP & RECOGNITION

Tom was chosen to participate in the Summer Honors Program at the New York City Law Department while in law school. He was also chosen for a Dean’s Merit Scholarship and received the Pro Bono award.
