NEWARK, NJ – CK has secured an outright victory on behalf of Diamond Chemical Company, Inc. In a published opinion, the NJ Appellate Division ruled that Diamond Chemical was not required to produce its corporate tax returns to the Plaintiff former employee, despite alleging that the employee caused it financial harm.

“In practice, this ruling could have significant impact on employment litigation, depriving plaintiffs of the oft-used discovery tactic of requesting returns without making a heightened showing,” noted Lauren Paxton, who served as lead counsel for Diamond Chemical, with Kevin Musiakiewicz and Gianna Bove on the briefs.
