PRIOR EXPERIENCE

Before joining Calcagni & Kanefsky, Josh held substantial regulatory and government securities enforcement positions with both FINRA and the New Jersey Office of the Attorney General. He also litigated in federal and state trial and appellate courts with the New York office of a prestigious global law firm, and later served as the Head of Litigation and Risk Management for an international technology company.

As Senior Counsel within FINRA’s Enforcement Department for four years, Josh investigated and prosecuted cases involving a wide range of securities concerns. His experience includes matters involving fraud, unauthorized transactions, conversion, money laundering, supervision, suitability, borrowing from customers, margin, net capital, outside business activities, and private securities transactions.

Prior to his post at FINRA, Josh served for three years as a Deputy Attorney General and the Assistant Section Chief of the Securities Fraud Prosecution Section of New Jersey’s Office of the Attorney General – Division of Law. There, he handled and supervised securities-related litigation and investigations on behalf of the New Jersey Bureau of Securities, the state regulator for New Jersey’s securities industry, and earned the prestigious Attorney General’s Award for his extraordinary service.

Following his public service, Josh served as in-house counsel for a privately-held technology company. As Head of Litigation and Risk Management, Josh supervised and directed all manner of litigation and served as the internal lead for the company’s most sensitive concerns.

Josh distinguished himself early on as an accomplished litigator within the New York office of an elite AmLaw 100 law firm. He built his reputation handling complex commercial and securities litigation, earning “Rising Star” and “Legal Lion” recognition by Super Lawyers and Law360, respectively.

Josh served as a judicial clerk for United States District Judge Freda L. Wolfson and United States Magistrate Judge André M. Espinosa, both of the U.S. District Court for the District of New Jersey.

Representative Matters
  • Successfully represented bondholders in federal litigation against the Republic of Argentina, culminating in a multi-billion-dollar settlement.
  • Successfully represented a corporate officer in an SEC civil fraud action involving allegations arising out of market timing, including a victory at the U.S. Supreme Court on an important issue concerning the statute of limitations for civil penalty actions.
  • Successful representation of the former shareholders of an armored car company, resulting in the award of a $16 million judgment and appellate affirmance of the dismissal of purported $100+ million counterclaims.
  • Obtained dismissal of a complaint brought by the former CEO of an Austrian bank against his former employer.
  • Obtained appellate dismissal of shareholder derivative claims brought against an aviation company.
  • Represented police unions in connection with federal “stop and frisk” litigation.
  • Successful representation of the CFO of a major financial institution in a joint investigation by the United States Attorney’s Office, Southern District of New York, and the SEC. Investigation closed with no action against client.
  • Successful representation of an outside director of a Chinese media company in an SEC investigation and shareholder derivative suit, resulting in no further enforcement action and dismissal of the shareholder’s claims.
  • Successful representation of a minority shareholder at trial in a corporate valuation proceeding, resulting in a favorable $2+ million judgment.
RECOGNITION AND INVOLVEMENT

Josh is the recipient of the prestigious Attorney General’s Award for extraordinary service to the New Jersey Office of the Attorney General. While in private practice, Josh was recognized as a New York “Rising Star” by Super Lawyers and as a “Legal Lion” by Law360.

In addition to his dedication to professional excellence, Josh is a devoted parent and community volunteer, serving as coach to his children’s local sports teams and on the Membership Committee of Temple Beth Shalom in his hometown of Livingston, New Jersey.
